NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW.  TO ENTER THIS SWEEPSTAKES, YOU MUST BE EIGHTEEN (18) YEARS OF AGE OR OLDER AS OF DECEMBER 14, 2009 AND A LEGAL RESIDENT OF AND CURRENTLY RESIDING IN THE CONTINENTAL UNITED STATES OR THE DISTRICT OF COLUMBIA.
1. ELIGIBILITY:
I Spiewak & Son’s (herein referred to as “Spiewak” or “Sponsor”) NY Trip Sweepstakes (the “Sweepstakes”) is only open to legal residents of the Continental United States and the District of Columbia (excluding Alaska, Hawaii, Puerto Rico, all U.S. Territories and Possessions and all Overseas Military Installations) who  are eighteen (18) years or older as of December 14th, 2009. All persons who are considered by the State in which he/she resides to be under the age of majority must have parent/legal guardian permission to participate.  All employees of Spiewak, as well as Zappos.com, Inc.; The Maritime Hotel; Jersey Boys (“Sweepstakes Entities”) and all associated agencies, sales representatives, distributors, licensees or agents of said affiliates, as well as their immediate family members (spouse, parent, child, sibling and their respective spouses) and those living in the same household of each (whether legally related or not), are ineligible to enter or win the Sweepstakes. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law. Entry in the Sweepstakes constitutes your full and unconditional acceptance of these Official Rules.
2. SWEEPSTAKES PERIOD:
The Sweepstakes entry period begins as of 12:01 a.m. Eastern Standard Time ("EST") on December 14th, 2009 and ends as of 11:59 p.m. EDT on December 21, 2009 (the "Sweepstakes Period"). The potential Winner will be selected from eligible entries properly submitted during the Sweepstakes Period.
3. SWEEPSTAKES ENTRY INSTRUCTIONS:
During the Sweepstakes Period as defined above, you may submit an entry online by visiting www.zappos.com/c/spiewak-bon-voyage and following the instructions to enter (“Online Entry”).  Limit one (1) entry per person, per e-mail address, during the Sweepstakes Period.  Failure to provide true and accurate information will automatically disqualify you from participating in the Sweepstakes.  Information collected from the entrant in the Online Entry will be used by Sponsor and Zappos.com, Inc. as indicated on the entry form, including entrants receiving e-mail announcements from Sponsor and/or Zappos.com, Inc., if entrant has elected to receive such e-mail messages.  If you choose not to receive e-mail messages, it will not decrease your chances of winning.  Entries will be treated in accordance with the privacy policies of Sponsor and Zappos.com, Inc.  See Sponsor’s Privacy Policy at: http://www.spiewak.com/fashion/privacy/.  See Zappos.com, Inc.’s Privacy Policy at: http://zappos.com/privacy.zhtml. 
4. PUBLICITY:
As a condition of entry into the Sweepstakes, except where prohibited by law, each entrant and each potential Winner by accepting the prize package (hereinafter referred to as the “Prize”) grants to Sponsor and Sponsor's affiliates, legal representatives, assigns and licensees, all right, title and interest in to publicize, broadcast, display and/or otherwise use the Sweepstakes entrant’s name, city, state, and biographical material (collectively, “Licensed Rights”) in any media now known or hereafter devised throughout the world in perpetuity for advertising and publicity purposes, without additional notice, review, compensation, permission or approval of the Winner.
5. SELECTION OF SWEEPSTAKES WINNER:
The potential Winner will be selected in a random drawing to be held on December 22, 2009. Odds of winning will depend on the number of eligible entries received. The potential Winner will be notified via e-mail to the e-mail address submitted with his/her entry within one (1) day after the drawing ("Prize Award Period"). The drawing will be conducted by Sponsor, the judge of the Sweepstakes, whose decisions on all matters relating to the Sweepstakes shall be final and binding. In the event of a dispute regarding the identity of the person submitting the Online Entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered by the appropriate internet service provider, business or other organization.  In the event that a potential Winner is disqualified for any reason or if a potential Winner cannot be reached after a reasonable attempt has been made or declines the Prize, Sponsor may, in Sponsor's sole discretion, award the Prize to an alternate potential Winner selected at random. Any return of Prize notification or Prize e-mail as undeliverable will result in forfeiture of any Prize and an alternate potential Winner may, at Sponsor's discretion, be randomly selected.  If the Winner is eighteen (18) years of age or older, but deemed a minor in his/her state of residence, the Prize will be awarded, on behalf of the minor, to his/her parent or legal guardian, who must comply with all requirements stated herein. 
6. PRIZES:
The Prize is defined as and limited to: Two round trip coach airline tickets of Spiewak’s choice for one Sweepstakes winner and his/her one guest to travel from a single location within the continental United States to New York City and back.  Guests will be entitled to a complimentary three days and two nights at the Maritime Hotel.  Guests will also receive 2 jackets following the trip following a mandatory fitting at Spiewak’s New York showroom.  Guests will also receive two tickets to the Broadway Show, Jersey Boys.  Approximate retail value is $2100.

Travel to New York City must be between January 4th- February 28th 2010, with blackout dates during New York Fashion Week (February 11th-18th).  Aside from the plane tickets from within the continental U.S. to NYC, hotel, jackets, and show tickets; winner and guest are responsible for ALL other expenses incurred, including but not limited to travel to and from the airport, travel after arriving in New York (subway, bus, taxi, rental car, etc.), food, entertainment, etc. Winner and guest will not be compensated for time taken off of work. Sweepstakes Entities are not responsible for flight delays and cancellations for any reason--or ensuing expenses resulting from such events.   Air travel and hotel accommodations are subject to availability.  Prize winner and guest will be required to be travel together on the same itinerary.  The passenger contracts in use by the airlines or other transportation companies shall constitute the sole contracts with respect to the Winner’s and his/her travel guest’s transportation and such contracts shall be solely between the Winner, his/her guest and such transportation companies.  Sweepstakes Entities shall not be parties to such contracts and shall assume no responsibility in this connection.  If the Winner is eighteen (18) years of age or older, but considered to be a minor in the state in which he/she resides, such Winner must be accompanied by his/her parent or legal guardian.  Guest must be of the age of majority in the state in which he/she resides, unless such guest is the child or legal ward of the Winner. 
Winner must contact Spiewak’s public relations department before December 23, 2009 at 5pm EST to set up dates for flight, hotel, and show tickets, or the Prize will be deemed forfeited.  Prize will not be replaced if lost or stolen. Prize is not redeemable for cash (except as required by law), and no substitutions are allowed. Winner may not transfer the Prize to another person.  The Prize will be delivered only to addresses in the United States. All federal, state and local taxes are responsibility of the Prize Winner. The Winner must provide Sponsor with a valid taxpayer identification number of Social Security number for tax reporting purposes before the Prize can be awarded.  The Winner also may be required to complete an affidavit of eligibility/liability/publicity release.  Sponsor's failure to enforce any term of these rules shall not constitute a waiver of that provision. In any cause of action, the Sweepstakes Entities’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Sweepstakes Entities be liable for attorneys' fees and/or experts' fees and costs. By participating in the Sweepstakes, entrants waive the right to claim any additional damages whatsoever, including, but not limited to, punitive, consequential, incidental or indirect damages. 
7. GENERAL RULES:
By entering or participating in the Sweepstakes, participants agree to be bound by these Official Rules, the terms and conditions of the Entities’ websites, and by the decisions of Sponsor, which are final and binding in all respects. Sweepstakes Entities are not responsible for: (1) any incorrect or inaccurate information or technical failures of any kind, (2) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (3) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the administration of the Sweepstakes, the processing of entries, or the selection or notification of winners. Further, if, for any reason, the Sweepstakes is not capable of running as planned for reasons outside the control of the Sponsor which, in the sole opinion of Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or portion thereof), Sponsor reserves the right, at Sponsor's sole discretion, to cancel, terminate, modify or suspend the Sweepstakes (or portion thereof). Sponsor also reserves the right at Sponsor's sole discretion to disqualify the Entry of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any website operated by the Sweepstakes Entities; (b) using any robotic, macro, automatic, programmed or like entry methods, which will void all such entries; (c) violating these Official Rules or the terms of service, conditions of use, and/or general rules of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person.  Any attempt to deliberately damage any website or undermine the legitimate operation of this Sweepstakes may be unlawful and subject to legal action by Sweepstakes Entities or their agents. Sweepstakes Entities, their parents, affiliated or subsidiary companies, and any entity which,  now or in the future, controls, is controlled by or under common control with them,  are not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of the Prize; participation in this Sweepstakes or in any activity or travel related thereto or from any interaction with, or downloading of, computer Sweepstakes information. Sweepstakes Entities make no warranties, and hereby disclaim any and all warranties, express or implied, concerning the Prize furnished in connection with this Sweepstakes. Any disputes that may arise hereunder shall be governed in all respects by the laws of the State of New York without regard to the conflicts of laws principles of any jurisdiction. Exclusive venue with respect to any such disputes shall be had in the state and federal courts located in the State of New York.  Except where prohibited, as a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, the Prize awarded or the determination of the Winner shall be resolved individually, without resort to any form of class action.
